N8700.46. on July 5, 2006. This notice
will currently
require many aircraft operators, particularly in
the business aviation industry, to ground their
aircraft by January 2007 unless they comply with
its requirements.
Notice
N8700.46 specifically affects aircraft operating
under an FAA Letter of Deviation Authority (LODA)
from the certification and operations specification
requirements of Part 125 of the Federal Aviation
Regulations (FAR). The notice instructs
FAA Flight Standards District Offices (FSDOs)
to re-interpret “full” or “blanket” deviation
as “deviation to the fullest extent permissible
by regulation and policy while maintaining an
equivalent level of safety.” If the FAA
fails to amend this notice or provide any extensions,
it is crucial to understand that:
Effective
January 6, 2007, all
LODA holders operating under full or blanket
deviation authority must ground their aircraft
until they fully comply with Notice N8700.46.
